1.         I refer to your letter of   26 June 1998 in which you appeal (under regulation 102 of the 1997 regulations) to the Secretary of State for the Environment, Transport and the Regions against the decision of XXX, the appointed person.  The appointed person upheld the decision of XXX Council that they were correct in applying Part K of the 1995 regulations to the calculation of the transfer value of funds from your private pension to the local government pension scheme.

 

2.         Under regulation 102(7) of the 1997 regulations the Secretary of State can only reconsider a disagreement about a matter relating to the local government pension scheme where the appeal is made within six months of the appointed person’s decision.  The Secretary of State notes that XXX issued his decision on 16 September 1997 and he informed you of the need to invoke the stage two appeal within six months.  Your appeal is therefore out of time and cannot be reconsidered.

 

3.           This completes the second stage of the internal disputes resolution procedure.  The Occupational Pensions Advisory Service (OPAS) is available to assist members and beneficiaries in connection with difficulties which they have failed to resolve.  Their address is 11 Belgrave Road, London, SW1V 1RB.
