December 2010

England and Wales

Version 3.1 of the GAD guidance in respect of the actuarial factors for individual Club transfers and cash equivalents has been added to the post 31 March 2008 GAD guidance page along with a copy of DCLG's letter dated 23 December 2010.

Minor amendments, due to the Stationery Office publishing a Correction Slip to the LGPS (Miscellaneous) Regulations 2009 [SI 2009/3150], have been implemented.

October 2010

England and Wales

There is now a hyperlink to the Ravensbourne Direction 2010 in paragraph 5 of the table in Part 1 of Schedule 4 to the Administration Regulations. The most recent version of the Administration Regulations now incorporates the amendments made by The Valuation Tribunal for Wales Regulations 2010 [SI 2010/713] and The Local Education Authorities and Children's Services Authorities (Integration of Functions) (Local and Subordinate Legislation) Order 2010.

CLG's cover letter for the LGPS (Miscellaneous) Regulations 2010 has been added to the Statutory Instruments page. Version 2.1 of the Actuarial Factors for Individual Cash Equivalent and Club Transfers and version of 2.1 of the Cash Equivalent factors for pensioner divorce together with the CLG cover letter have been added to the GAD guidance for the post 31 March 2008 scheme.

The most recent version of the LG (Early Termination of Employment) (Discretionary Compensation) (England and Wales) Regulations 2006 now includes the amendments made by The Local Education Authorities and Children's Services Authorities (Integration of Functions) (Local and Subordinate Legislation) Order 2010.

Scotland

Version 2.1 of the Actuarial Factors for Individual Cash Equivalent and Club Transfers and version of 2.1 of the Cash Equivalent factors for pensioner divorce have been added to the GAD guidance for the post 31 March 2009 scheme.

United Kingdom

The Central Club Factors and a cover letter from the Cabinet Office have been added to United Kingdom guidance page.

September 2010

England and Wales

The update includes The Local Government Pension Scheme (Miscellaneous) Regulations 2010 [SI 2010/2090], a pdf version of the files together with the associated Explanatory Memorandum. A new set of LGPS Regulations 2007/2008 has been created to reflect the amendments to the LGPS Regulations made by SI 2010/2090.

The LGPS Regulations 1997 have been updated with the amendments in SI 2010/2090.

July 2010

England and Wales

The two CLG letters (dated 6 July 2010 and 20 July 2010) on non-Club CETVs and CPI have been added to the post March 2008 GAD guidance page.

Scotland

The update includes creation of timeline regulations for the LGPS (Management and Investment of Funds) (Scotland) Regulations 2010 and the archiving of the historical versions of the LGPS (Management and Investment of Funds) (Scotland) Regulations 1998. The pdf versions of SSIs 2010/233 and 2010/234 have been replaced with webpage versions on the Scottish Statutory Instruments page.

A new set of LGPS (Scotland) Regulations 2008 has been created to incorporate the amendments made to the LGPS (Administration) Regulations 2008 and the LGPS (Benefits, Membership and Contributions) Regulations 2008 as amended by SSIs 2010/233 and 2010/234.

June 2010

England and Wales

The GAD guidance (dated 29 April 2010) on the application of Pension Debits together with CLG's covering letter have been added to the post March 2008 GAD Guidance page.

Scotland

The LGPS (Management and Investment of Funds) (Scotland) Regulations 2010 [SSI 2010/233] and The LGPS Amendment (Scotland) Regulations 2010 [SSI 2010/234] with the associated Executive Notes have been added to the Statutory Instruments page.

SPPA Circulars 2010/No.4 and 2010/No.5 and the guidance with respect to regulation 12(3) of the LGPS (Management and Investment of Funds) (Scotland) Regulations 2010 have been added to the Statutory Guidance & Circulars page.

May 2010

England and Wales

The post 31 March 2008 GAD guidance page has been updated with:

version 2 of the Individual Incoming and Outgoing Transfer guidance together with CLG's cover letter; and
an updated version of the GAD guidance on Trivial Commutations.

Scotland

Circular SPN/LG No.3/2010 and version 4 of the guidance for the Assessment of Membership Contribution Rates have been added to the Statutory Guidance & Circulars page.

April 2010

England and Wales

This month's update includes:

a minor amendment to the definition of "qualified in occupational health medicine" in regulation 20(14) of the Benefit Regulations as per The General and Specialist Medical (Education, Training and Qualifications) Order 2010 [SI 2010/234]; and

the Statutory Instrument page has been updated with CLG's cover letter to The LGPS (Amendment) Regulations 2010 [SI 2010/528].

Scotland

This month's update includes:

United Kingdom

The Pensions Increase page now includes the Pensions Increase multiplier spreadsheet for 2010 issued by HM Treasury together with their explanatory note. The Social Security Revaluation of Earnings Factors Order 2010 [SI 2010/470] has been uploaded to the Section 148 Orders page along with the accompanying Explanatory Memorandum.

March 2010

England and Wales

The update includes The Local Government Pension Scheme (Amendment) Regulations 2010 [SI 2010/528], a pdf version of the files together with the associated Explanatory Memorandum. A new set of LGPS Regulations 2007/2008 has been created to reflect the amendments to the Benefit Regulations and the Administration Regulations made by SI 2010/528.

Three documents have been added to the Statutory Guidance and FAQs page. They are CLG's letter (dated 19 February 2010) on admission agreements ceasing to have effect and the ability to collect outstanding contributions, CLG note (issued 4 March 2010) on the pooling of pension funding assets after 31 March 2010 and CLG's supplementary informal guidance (issued 4 March 2010) on investing with a local authority.

Scotland

The Statutory guidance page has been updated with version 3 of the Statutory Guidance on the assessment of member's contribution rates. The link to the Statutory Guidance from regulation 4 of the Benefit Regulations 2008, as amended by SSI 2009/187, has been updated to reference the latest guidance.

There was no update of the entire website in February 2010.

January 2010

The Pensions Increase Review Orders page now has hyperlinks to letters from CLG (dated 21 January 2010) and SPPA (dated 25 January 2010) which state that the PI rate for April 2010 will be 0%.

December 2009

England and Wales

The Local Government Pension Scheme (Management and Investment of Funds) Regulations 2009 [SI 2009/3093] together with the explanatory memorandum have been uploaded to the Investment regulations section of the Timeline Regulations website. Archived versions of the 1998 Investment Regulations can be accessed from the new menu page for the 2009 Investment Regulations.

The Admitted body status provisions guidance together with the CLG covering letter (dated 17 December 2009) and the CLG letter (dated 14 December 2009) in respect of regulation 12(3) of the 2009 Investment Regulations have all been added to the Statutory Guidance page.

Upload of the Local Government Pension Scheme (Miscellaneous) Regulations 2009 along with the accompanying explanatory memorandum. This month's update includes the resultant amendments to the Benefit Regulations, the Administration Regulations and the Transitional Provisions Regulations 2008.

Version 1.2 of the GAD guidance on buying an additional pension has been added to the post March 2008 GAD guidance page.

November 2009

England and Wales

On 7 October, CLG issued a letter in respect of employees, who will be made redundant on 31 March 2010 and the early payment of Pension Credit benefits. Links to the letter have been added in the Statutory Guidance/FAQs webpage and in the Divorce section at the bottom of the post March 2008 GAD guidance webpage.

The correction slip, which was issued in September with respect to the Local Government Pension Scheme (Amendment) Regulations 2008 [SI 2008/1083], has been added to the Statutory Instruments page. The Timeline Regulations have been updated to include the amendments required due to the Correction slip.

There was no update of the Timeline Regulations website in October 2009.

General

A number of typographical and layout errors have been corrected.

September 2009

England and Wales

Annexes B and C, which accompany the Statutory Guidance on Ill-health, have been added to the Statutory Guidance and Circulars page.

Scotland

The Local Government Superannuation (Scotland) Regulations 1987 are now available on the Timeline Regulations (Scotland) section. The draft GAD guidance on Protected Regulation 65(8) from the LGPS (Scotland) Regulations 1998 has been uploaded to the post March 2009 GAD guidance page.

August 2009

England and Wales

The Statutory Guidance and Circulars page has had added the Supplementary Guidance for Independent Registered Medical Practitioners qualified in occupational health medicine (IRMPs) together with the covering letter from CLG and the Faculty of Occupational Medicine.

Scotland

The Local Government Superannuation (Scotland) Regulations 1987 have been added to the Timeline Regulations (Scotland) page.

Version 1.2 of the Actuarial Factors for Individual Cash Equivalent and Club transfers for members of the LGPS (Scotland) has been added to the post March 2009 GAD guidance page. Version 1.1 has been moved to a new section (called "Previous Guidance issued") at the bottom of the same page.

The joint Police, Fire and Local Government Circular (2009/No.1) has been added to the Statutory Guidance and Circulars page.

The update included corrections to a few typographical errors.

June 2009

England and Wales

A link to the CLG letter dated 18 November 2008 has been added in the section headed "Administration Regulation 79 Rights to payment out fund authority's pension fund & 83 Inward transfers of pension rights".

Scotland

An updated version of the LGPS (Scotland) Regulations 1998 has been created to incorporate the changes in The Local Government Pension Scheme Amendment (Increased Pension Entitlement) (Scotland) Regulations [SSI 2009/186].

A updated version of the Local Government (Discretionary Payments and Injury Benefits) (Scotland) Amendment Regulations 2009 and a new set of the LGPS (Scotland) Regulations 2008 have been created due to the amendments made by The Local Government (Discretionary Payments and Injury Benefit) (Scotland) Amendment Regulations 2009 [SSI 2009/187].

The Scottish Statutory Instruments page now includes SSIs 2009/186 and 2009/187 together with the accompanying explanatory memoranda.

SPN/LG Circular No.4 /2009 has been added to the Statutory Guidance and Circulars page.

May 2009

England and Wales

A new set of the LGPS Regulations 2007/2008 has been created to incorporate the minor changes contained within the LGPS (Amendment) Regulations 2009 (SI 2009/1025). The SI itself together and an explanatory letter from CLG have been added to the Statutory Instrument page.

The GAD guidance page for the post 31 March 2008 Scheme now includes the guidance CLG issued in respect of AVC Service Credits, version 1.3 of the Actuarial Factors for Individual Cash Equivalents and Club Transfers with effect from 1 October 2008 guidance and the letter CLG issued in respect of interfund adjustments where the date of election occurs after 31 March 2009. Earlier versions of the Actuarial Factors for Individual Cash Equivalents and Club Transfers with effect from 1 October 2008 have been moved to a new section entitled, "Previous guidance issued" at the bottom of the Post 31 March 2008 GAD Guidance page.

The second edition of the FAQ document has been added to the Statutory Guidance / FAQs page.

Scotland

SPN/LG Circular No.2 /2009 has been added to the Statutory Guidance and Circulars page.

Spurious characters, which appeared in the set of LGPS (Scotland) Regulations 2008 as amended by SSI 2009/0093, have been removed.

April 2009

England and Wales

Details of an appeal has been added in respect of whether or not calendar length membership counts toward the rule of 85 calculation. Appeal reference numbers hyperlinks now open in a new browser window.

Scotland

The Statutory and Circulars page has had the SPPA letter (dated 20 February 2009) added. It covered the LGPS (Discretionary Payments and Injury Benefits) (Scotland) Amendment Regulations 2008.

March 2009

England and Wales

A new set of the LGPS Regulations 2007/2008 has been created to incorporate the minor changes contained with the LGPS (Administration) (Amendment) Regulations 2009 (SI 2009/447).

The CLG letter (issued on 2 March 2009) and both versions of the clarification on pensions and divorce (issued on 2 and 12 March 2009), the updated Protected Rights factors, the Supplementary Lump Sum Factors at Age 55 for Pensioner Cash Equivalents and the LGPS (Scotland) Actuarial factors for individual cash equivalent and club transfers have been added to the post April 2008 GAD guidance page.

The hyperlinks in regulations 79, 83 and 86 of the Administration Regulations have been amended to take users to the relevant section of the GAD guidance page the post March 2008 scheme instead of a particular item of GAD guidance.

Users can now request copies of the SIs which amended the LGPS Regulations 1995 from the menu page.

Scotland

A new set of the LGPS (Scotland) Regulations 2008 has been created to reflect the amendments contained within the LGPS Amendment (Scotland) Regulations 2009 (SSI 2009/93).

A new page to display GAD guidance for the post March 2009 scheme has been created. The GAD guidance in respect of early retirement, late retirement, purchase of an additional pension (under regulations 13 and 14 of the Benefit Regulations 2008) and the use of accumulated AVC's to provide an additional pension are listed on the page. The guidance, previously issued in respect of individual Club transfers and cash equivalents, additional cash commutations and with regard to benefits in excess of the Lifetime Allowance where the member is without Primary or Enhanced Protection, have been added to the post March 2009 guidance page.

A link to the GAD guidance for the post March 2009 scheme page has been added to all the appropriate navigation menu bars.

United Kingdom

The GMP Increase page now includes the Guaranteed Minimum Pensions Increase Order 2009 and the SI for the 2009 PI Review with HM Treasury's 2009 PI multiplier spreadsheet have been added to the Pensions Increase page. There is a new page which contains the latest Public Sector Transfer Club Memorandum and the associated covering letter which were issued on 29 January 2009.

February 2009

England and Wales

The LGPS Regulations 1995 (As Amended) have been added to the Timeline Regulations for England and Wales.

CLG issued a letter on 13 January 2009 which contained the new contribution rates effective from 1 April 2009. This letter has been added to the Statutory Guidance / FAQs page and there is a hyperlink to the letter from the most recent version of the Benefit Regulations 2007.

Scotland

SPN/LG Circular No.4/2008 (The LGPS (Scotland) Guaranteed Minimum Pension (GMP) Entitlement) has been added to the Statutory Guidance and Circulars page.

Navigation

Navigation menu bars have been introduced in all the top-level menus to make it easier for users to navigate around the Timeline Regulations website.

Hyperlinks

The Timeline Regulations website has been enhanced in order that hyperlinks to external pages will open in a new browser window. External pages include SIs, SSIs, statutory guidance, GAD guidance etc. With respect to the LGPS Regulations 2007/2008, the Benefits Regulations 2007 are regarded as external to the Administration Regulations 2008 and the Transitional Provisions Regulations 2008 and vice versa. The same approach has been taken to the LGPS (Scotland) Regulations 2008. The new browser window enhancement has only been implemented in the pages listed below.

England and Wales

Create a new set of regulations in the Local Government Pension Scheme Regulations 2007 / 2008 (As Amended) section as a result of SI 2008/3245. Note that the SI made amendments to the LGPS (Administration) Regulations only.

The Guidance on Staffing Issues, with respect to the boundary changes effective from 1 April 2009, has been added to the Statutory Guidance/FAQs page and the relevant SI has been inserted in the SI page. The letter issued by CLG on 22 December 2008 in respect of IFAs in the current financial has been added to the GAD guidance page for the post 31 March 2008 scheme. A hyperlink to the Disability Discrimination Act guidance has been inserted in regulation 44(6) of the LGPS Regulation 1997 as amended by SI 2008/2425.

The layout of regulation 26(5) of the Benefit Regulations (as amended by SI 2008/1083, SI 2008/2425, SI 2008/2989 and SI 2008/3245) has been tidied up so that clauses 26(5)(a) and 26(5)(b) appear on separate lines and are indented.
